Corporate
Email Discovery
It’s no secret
that businesses and individuals are creating, receiving and
storing more information than ever before. An analysis
conducted by the University of California at Berkeley determined
that 93% of all information today is created in an electronic
format. This makes
email
discovery and Outlook discovery
a critical
issue in today's corporate environments. It has been estimated
that one-half of information included in legal discovery today
is found in email systems. As corporate litigation becomes more
and more prevalent, it is no longer a question of whether a
company will be involved in a lawsuit, but rather a question of
when.
Osterman
Research estimates that roughly three out of four discovery
orders today require email discovery as part of the process.
However, the use of e-discovery tools can be applied to
situations outside of the traditional litigation process. These
uses include, but are not limited to, helping to manage and
avoid employee misbehaviour and legal actions; helping an
organization to comply with its regulatory obligations;
preserving intellectual property, knowledge and other data;
storage management; and avoiding embarrassing data loss or
leaks.
A key driver
for the discoverability of electronic content is the recent
amendments to the Federal Rules of Civil Procedures,
focusing much more attention on the discovery of electronically
stored information (ESI). Since organizations are liable for all
the content held in their systems, it is imperative that
companies have a clear set of procedures and tools in place
should a document discovery request be received especially when
it comes to email discovery and Outlook discovery.
